The Mid-Currituck Bridge has been debated for decades. If you recall, this is the proposed toll bridge from the Currituck mainland to Corolla. Our post from 2015 made it appear as though it was finally in the fast lane. The post reported DOT had approved the request to spend at least $5.7 million on land purchases to purchase rights of way for the bridge project in November 2015.
The latest news on the bridge is NC Department of Transportation filed a condemnation complaint on June 21, 2017 on the site for the Corolla side needed for the proposed bridge. The NC DOT and the land owners of the site, could not come to an agreement regarding the purchase price. The price offered was not disclosed.
A condemnation complaint is used by the DOT for “quick take” power under Chapter 136 Article 9. Title vest to the Condemnor immediately upon filing the eminent domain lawsuit and depositing the condemnor’s estimate of just compensation. The measure of damages is the difference in the property’s value before and after the taking and could result in a zero verdict by the jury.
The NC DOT has acquired a parcel adjacent to the site involved in the condemnation. The DOT has been attempting to purchase property involved in the bridge project while costs are lower and before any development occurs.
The DOT has deposited a vouchers for $488,000 with the Currituck Clerk of Superior Courts Office. The property owners may apply to the court to receive payment of the funds, either as full payment or a credit toward what is eventually decided to be constitutionally guaranteed compensation.
The complaint is supposed to be served to the listed agent for the land owners.
Prior reports indicated construction of the bridge could begin as early as 2017. Currently, no date for the bridge’s construction has been finalized. The bridge will cost an estimated $440 million.
